1.    TERMS AND CONDITIONS

These terms and conditions govern your use of the website of THE AFRICA MARKET PLACE (also known as MY AFRICAN SUPERMARKET) by using our website, you accept these terms and conditions in full, If you disagree with any part of these terms and conditions, do not use our website.

5.   Product Descriptions

MY AFRICAN SUPERMARKET lists descriptions with products to assist customer in understanding the product and their buying decisions. Descriptions are taken from material provided by the the supplier or manufacturer, whether by packaging, promotional material or information specially provided.

Whilst we take reasonable care for honest and accuracy - MY AFRICAN SUPERMARKET does not take responsibility for the correctness or value of these statements and requires customers to make their own judgments in the buying decision just as they would when buying the product off the shelf in the store.

6.  Sale of alcohol
We will not sell to anyone who is not 18 years of age or over, as the law requires.
By placing an order you confirm that you are at least 18 years old.
If you are buying a product/s as a gift - the recipient must also be over 18 years old.
If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID.
If the person receiving the order is unable to produce appropriate ID, unfortunately our couriers will be unable to leave the products.


8. Security and Fraud

We make all efforts to protect both our customers and ourselves and to prevent fraud. This also depends upon customers and visitors to our site and shop following rules and procedures. We reserve the right to prohibit usage or access by anyone breaking the rules or conventions and may report behaviour to the police if it appears to be illegal.

 9. Limitation of liability

At all times our acceptance of an order takes place on despatch of the order, at which point the purchase contract will be made. If we are unable to deliver the ordered goods we may offer you substitutes which you may reject - we will refund, within 7 days, the amount paid for goods we are unable to supply.

All offers are subject to availability and while stocks last.

MY AFRICAN SUPERMARKET shall not be liable to any customer or household for any financial loss arising out of the website for placing orders.

 10.    Miscellaneous

We reserve the right to vary or terminate the operation of any activity at any time without notice.

The failure of MY AFRICAN SUPERMARKET to take any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceability. We reserve the rights in respect of these terms and conditions at all times.

11.    Availability of the Online Site

Although MY AFRICAN SUPERMARKET aims to offer you the best service possible, MY AFRICAN SUPERMARKET makes no promise that the services at the MY AFRICAN SUPERMARKET Site will meet your requirements. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.

If you breach these Terms and Conditions and MY AFRICAN SUPERMARKET ignores this, MY AFRICAN SUPERMARKET will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

MY AFRICAN SUPERMARKET shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.

A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act

 15. Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.

 16. Damaged goods return policy
The procedure for damaged goods is:

1.   All goods must be inspected upon delivery, where goods are found damaged, they should be handed back to our couriers, who will return these goods to us, and arrangements will be made with you, to delivery replacement goods.

2.   If goods are delivered in your absence, please keep the goods in their original packaging UNOPENED, use our contact page to advise us and we will send you a payment link to pay for collection.

Once you have paid the fee we will arrange for a call and collection.

This does not affect your statutory rights

 17. Delivery

Our standared delivery is within 5 working days. However we endevour to deliver within 2 working days upon receipt of your order( this is when your payment for the order has cleared). 

We make every effort in the automated e-mail you receive immediately after placing the order in details published on site and in the e-mail to you advising that the order has been despatched to you. It is your responsibility  to ensure that you have provided your e-mail address correctly and that you check your e-mail for notifications from us.
To ensure that the goods can be delivered as agreed with you - this will be to your address for a signature where you have not given us alternative instructions.

If the delivery service is unable to deliver they will leave a card for you to contact them to arrange a re-delivery convenient to you. All deliveries are weekends.

You may specify an alternative address or place to leave the goods either when placing the order or by contacting us before goods are despatched. If the goods remain with the delivery service for four days  undelivered they return the goods to us at our expense.

If you ask us to leave the goods in a place that is not secure and for which we cannot get a signature for receipt, their safety and the condition of the goods is entirely at your risk and we do not guarantee replacements. You may decide that it would be better to allow us to leave at any nearby address for a signature for receipt and you are then better protected.

Goods returned to us  may be returned to you for an additional delivery fee (we will not charge you for the extra cost incurred in returning the goods back to us). We will e-mail a payment link to you for this fee before re-delivering.

If you decide not to have the goods re-delivered to you, we will refund to you the original payment less the original deliver fee and also deduction of the delivery service return fee that we will have to pay.

 This may be extended if you have contacted them and agreed a delivery date.

 Upon receipt of your order, the order should be carefully inspected to make sure that it is intact and in full. The courier must be informed of breakages or shortages at the time of delivery. We will not accept any claims for breakages or shortages unless they are stated on the courier’s documentation. We must have confirmation of these breakages or shortages within 3 working days of delivery.

 18. Excluded Services

The services provided by the MY AFRICAN SUPERMARKET Site do not include the provision of computer or other necessary equipment to access the MY AFRICAN SUPERMARKET Site. To use the MY AFRICAN SUPERMARKET site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.

19. Restricted access

Access to certain areas of MY AFRICAN SUPERMARKET website is restricted. We reserve the right to restrict access to other areas of the website, or indeed our whole website, at our discretion.

If we provide you with a user ID and password to enable you to access restricted areas of our website or other content or services, you must ensure that that user ID and password is kept confidential.  You accept responsibility for all activities that occur under your user ID or password.

 We may disable your user ID and password at our sole discretion OR if you breach any of the policies or terms governing your use of our website or any other contractual obligation you owe to us
